Stanford Health Care (“SHC”, “we” or “us”) offers this site and its related applications (“apps” or “app”) and services to you subject to your compliance with the terms, conditions, and notices set forth below. SHC reserves the right to limit or terminate your use of MyHealth if you fail to abide by the Terms and Conditions. Please take the time to review them carefully.

Acceptance of Terms and Conditions

When you access, use or view this website or mobile app, you thereby agree to be bound by this agreement regarding the terms and conditions of use (“Terms and Conditions”). Please note that SHC may revise these Terms and Conditions at any time by updating this posting. If you access, use or view this website or app after such revisions have been made, you may be forced to accept the revised Terms and Conditions and you will be bound by them; therefore, we advise you to periodically review this page for such revisions. If you do not agree to these Terms and Conditions, please exit this website and app promptly. The pages on this website and app are also subject to the SHC website’s general terms and conditions.

User Responsibility

You agree that the MyHealth service is offered as a convenience to you as an SHC patient, that it permits you to access portions of your SHC medical record, and that you are solely responsible for any MyHealth information that you communicate, whether intentionally or not, to others. As SHC employees other than your individual healthcare provider may be involved in handling your communications, you should not use MyHealth for confidential information you wish to discuss only with your health care provider. You are responsible for any use of MyHealth by your agents or dependents, and you agree to inform such agents or dependents of these Terms and Conditions and their obligations to comply with them. You may not assign the rights and obligations accruing to you under these Terms and Conditions without the prior written consent of SHC, and any attempted assignment not in compliance with this sentence shall be void.

Your Health

MyHealth is not a substitute for direct care and should not be used for emergencies or urgent matters that could affect your health. In emergency or urgent situations, you should not use MyHealth, but instead should dial 911, contact your physician directly, or go to the nearest emergency room. NEVER USE MYHEALTH FOR URGENT OR EMERGENCY MATTERS.

Your Health Information

By agreeing to these Terms and Conditions you provide Stanford Health Care the right to release portions of your personal health information to you via MyHealth to include, but not limited to, laboratory and other test results, summary of medical problems and history, medications, and allergies. The information contained on MyHealth may be a summary of certain information within your medical record and will not reflect your complete medical record. A complete copy of your medical record can be obtained by contacting SHC’s Health Information Management Services at 300 Pasteur Drive, Stanford, CA 94305.

Your Test Results

By agreeing to these Terms and Conditions you request Stanford Health Care to post all test results to MyHealth that are not expressly forbidden by law. Should you decide you no longer would like electronic transmission of your test results, you can choose to deactivate your account. Not all test results and other such information are posted to the MyHealth site. Therefore, it is your sole responsibility to ensure that you request and verify results for all tests you have taken by contacting SHC directly.

Your Stanford Health Care Bill

By agreeing to these Terms and Conditions you are automatically opted-in for paperless billing. You can view, print, and pay your Stanford Health Care bill by going to the MyHealth mobile app or website and selecting “Billing”. When there is a new bill to be paid, you will be notified by email and also by push notification if you have the MyHealth mobile app and have allowed notifications.

You can choose to opt-out of paperless billing at any time by going to the Billing section of MyHealth and selecting “cancel paperless billing”. You would then receive paper bills in the mail in addition to the electronic version of the bill that appears in MyHealth.

By agreeing to these Terms and Conditions you request Stanford Health Care to post all test results to MyHealth that are not expressly forbidden by law. Should you decide you no longer would like electronic transmission of your test results, you can choose to deactivate your account. Not all test results and other such information are posted to the MyHealth site. Therefore, it is your sole responsibility to ensure that you request and verify results for all tests you have taken by contacting SHC directly.

Your Privacy

SHC considers your privacy to be of vital importance. Please review our Notice of Privacy Practices which explains how SHC may use and disclose protected health information The paragraph below explains our use of cookies and the usage data collected by our web server while using MyHealth.

Upon accessing MyHealth, our web server collects and stores the following usage data: (1) the domain name from which you access the Internet; (2) the date and time you access the site; (3) the pages you visit; (4) the address of the website from which you linked directly to us; (5) the name and release number of the web browser software you are using; and (6) the IP (Internet Protocol) address of the computer you are using. This information is used by SHC for internal evaluation, quality control, and other reasons deemed appropriate by SHC. Your continued use of MyHealth will be taken as consent to the collection, use and disclosure of the usage data described above.

Information Sent by Your Mobile Device

We collect certain information that your mobile device sends when you use our website, app and service, like a device identifier, user settings and the operating system of your device, as well as information about your use of our website and app.

Location Information

When you use MyHealth on your mobile device, we may collect and store information about your location by converting your IP address into a rough geo-location or by accessing your mobile device’s GPS coordinates or by proximity to a Bluetooth beacon or course location if you enable location services on your device. We use location information to provide SHC relevant location services such as automatic arrival (eArrival) where we mark you as arrived when you get to one of our facilities, and indoor navigation (Wayfinding) at our facilities. If you do not want us to collect location information, you may disable that feature on your mobile device, but you will not be able to utilize location enabled services of MyHealth.

Email Opt-Out

SHC may periodically send you free newsletters and emails with information related to health services, wellness, events and news about Stanford Health Care. You can unsubscribe from these emails by clicking on the “unsubscribe” link in the bottom of the newsletter or by adjusting your email subscription preferences in MyHealth.

SHC also does need to send you emails related to delivery of your health care including but not limited to; messages from your care team, appointment details and reminders, after visit summaries, test results, payment of your SHC bills, health maintenance, and messages related to your MyHealth account. You will not be able to opt out of these communications if you wish to continue using MyHealth.

MyHealth Enrollment

Your enrollment in MyHealth is contingent on verification of your identity. If you enroll in MyHealth in person or by mail, you will receive an access code from SHC. This access code will permit you to create a user identification (“MyHealth ID”) and password, which will be used to log into the site. If you fail to use your access code within sixty (60) days of receiving it, it will expire and you will have to obtain a new access code from SHC to enroll in MyHealth. After you create your User ID and password, your access code will immediately expire and can no longer be used. You may also receive an invitation to enroll in MyHealth via SMS. Upon receiving this invitation, you will be required to verify your identification and create your User ID and password. These SMS invitations are valid for limited period of time (currently 90 minutes). Once expired, you can no longer utilize an SMS invitation to create an account and will have to contact the MyHealth Help Desk (866) 367-0758 or your SHC clinic to receive another SMS invitation. Note that you may be subject to charges for SMS messaging from your wireless provider depending upon your service plan.

Passwords

The security of your personal health information contained in your MyHealth is dependent upon selecting a secure password. It is your responsibility to create a secure password. At a minimum your password must be between eight and fourteen characters long, contain at least one letter and one number and cannot be the same as your User ID. Passwords should not contain words, your birthday, your social security number or any other easily guessed information.

It is extremely important that you keep your access code, User ID and password confidential, as anyone who knows them will have access to your confidential medical information and can send and receive electronic communications as if he or she were you. It is your responsibility to safeguard your User ID and password, and to notify SHC immediately and change your password if you believe the security of your information has been compromised. In addition, in order to maintain the security of the site, you may be forced to change your password at any time, without prior notice, upon login and before you are allowed access to your account. You can change your password by clicking the “Change Password” link on the MyHealth homepage. If it is discovered that you have inappropriately shared your password with another person, or otherwise misused or abused your privileges to access MyHealth, SHC may discontinue your access to MyHealth without prior notice.

Electronic Communications

SHC or its team may send you secure messages through MyHealth which contain confidential medical information and other information important to the maintenance of your health. All communications that are transmitted and received through the MyHealth site are subject to all state and federal laws guarding the security and confidentiality of medical records. All communications using MyHealth take place via a secure Internet connection. You will receive electronic mail (“e-mail”) notifying you that new information is available for you on MyHealth but these e-mails will not contain any confidential medical information.

You may also communicate information to MyHealth through the secure Internet connection. When using MyHealth to send secure messages to the health care team, use the provided drop down box relating to the subject of the communication in the message’s subject line. If your provider is not available, messages sent through MyHealth may be forwarded to other authorized SHC health providers.

MyHealth is not intended to replace or to serve as a substitute for in-person meetings and/or personal conversations with your physician. If MyHealth is unavailable, you should use other means to contact SHC and your health care team for non-urgent matters.

Please note that the contents of any MyHealth communication may become part of your permanent health record. This communication does not constitute an addendum or amendment to your existing medical records and may not be considered part of SHC’s designated medical record set. To exercise your legal rights in requesting an addendum or amendment of your medical records you should contact SHC’s Health Information Management Services at 300 Pasteur Drive, HC006, MC 5202 Stanford, CA 94305-5202.

Security; Risks of Using Secure Sites and Secure Messaging

SHC uses 128-bit encryption technology and takes other precautions to ensure that the information contained or transmitted via MyHealth is as secure as reasonably possible from unauthorized use or access. As such, your browser must be enabled to transmit via Secure Socket Layer (SSL) protocol and 128-bit encryption. If your browser currently does not support this protocol, you will see a prompt asking you to update your security and a link to a site where you may obtain the necessary plug-in at no charge. SSL is used for transmitting personal demographic information, personal health information and credit card information. SHC is using industry-standard encryption technologies to protect and secure the MyHealth site, including the secure messaging function. Because of the added security of web-based, encrypted messaging, SHC strongly recommends the use of secure messaging via MyHealth, instead of e-mail, for online communications.

However, please note that while SHC takes measures to safeguard your security, we cannot guarantee absolute security of the system against inadvertent disclosure or intentional intrusion. The use of electronic communication systems such as the World Wide Web (including secure messaging) for communications has a number of risks that users should consider before use. Such risks include, but are not limited to, the following:

As a result of these risks, SHC cannot guarantee the security and confidentiality of secure messaging and other communication submitted through MyHealth, and will not be liable for improper disclosure of confidential information.

Usage of MyHealth Messaging

MyHealth messages are intended for non-urgent medical questions to your clinic care team. MyHealth messages can also be used for care coordination, visit follow-ups, and questions about prescriptions, test results, and billing.

Medical questions may not be answered before your first visit. Your physician may address your questions once he or she has evaluated you.

If MyHealth messaging is used inappropriately, your care team may redirect you to schedule a visit or to some other channel or service to answer your question or address your need.

Accuracy and Integrity of Information

SHC attempts to ensure the integrity of the site, but makes no guarantees about the accuracy of the site. It is possible that the site would include typographical errors, inaccuracies, or other errors. Should you find any information to be inaccurate, please submit a written and signed request to SHC’s Health Information Management Services at 300 Pasteur Drive, HC006, MC 5202 Stanford, CA 94305-5202 explaining which information is inaccurate and how it should be corrected. Information contained on the SHC site may be changed or updated without notice. Submission of a signed request does not guarantee the information will be updated nor imply a timeframe for updates.

Website and App Availability

Although SHC works to communicate when MyHealth will be unavailable due to maintenance, backup procedures, or other system outages, providing such advance notice may not be possible at all times, and SHC cannot guarantee that you will be able to access MyHealth at any particular time. During times when MyHealth is unavailable, other communication methods (such as the telephone) should be used to contact SHC.

License and Restrictions

SHC grants you a limited, revocable, nontransferable and nonexclusive license to access and make personal use of this website, the material provided hereon, and the accompanying services. You may not, however, in whole or in part use, reproduce, or copy the MyHealth site or modify any content or any proprietary notices from materials downloaded or printed out from MyHealth. Furthermore, this limited, revocable license does not include the right to: any use of the content of this site for the benefit of a third party or for personal financial benefit, except as MyHealth contemplated by these Terms and Conditions; any derivative use of this website or its contents; any transmission or provision of any content from the MyHealth site to a third party, except as specifically provided by these Terms and Conditions; any incorporation of data or other content from MyHealth in a product designed, developed, marketed, sold or licensed by you or on your behalf, except as permitted by FHIR APIs; any use of data mining, robots, or similar data gathering and extraction tools; or any use of MyHealth in a manner contrary to any applicable law. Sharing Health Data with 3rd Party Apps

SHC allows 3rd Party Apps to register to access health record data, using a standard set of application programming interfaces (APIs) like FHIR.

To do so, you would access a FHIR API enabled 3rd party app and provide your MyHealth ID and password so that data can be downloaded from your SHC health record.

Before granting access, please read the 3rd party app’s terms and conditions and privacy policy carefully to be sure that you understand how the 3rd party app and app developer may use your data.

The 3rd party app was not created by Stanford Health Care and Stanford Health Care accepts no liability for the 3rd party app. Stanford Health Care is not an agent for 3rd party app developers nor does Stanford Health Care endorse or guarantee 3rd party apps. Stanford Health Care makes no representation or warranty regarding the accuracy or suitability of the 3rd party app. By granting access, you are allowing the 3rd party app to access your personal health data. Stanford Health Care has no control over the 3rd party app or your data, including how the 3rd party app further discloses your data, once your data has been accessed by the 3rd party app. Note that Stanford Health Care’s privacy policy does not extend to the 3rd party app. The 3rd party app developer may not be subject to the same obligations to protect your personal health information as Stanford Health Care, and your data might be used for advertising or other secondary purposes.

Applicable Laws; Arbitration; Venue

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to conflicts of law principles. You agree that any dispute, controversy or claim arising out of or related to these Terms or your use of the Site will be solely and exclusively resolved and settled through arbitration administered by the American Arbitration Association and conducted in Santa Clara, California, United States of America. Judgment on any award rendered by the arbitrator may be entered in any court of competent jurisdiction. The prevailing party shall be entitled to costs and reasonable attorney’s fees arising out of such arbitration.

Representations of User

You hereby represent and warrant that (1) you are at least eighteen (18) years old, or have provided Stanford Health Care with a court order indicating that you have obtained emancipated minor status, and that you possess the legal right and ability to enter into this agreement and to use the website in accordance with these terms and conditions; and (2) the information you submit to SHC to gain registration is accurate, true, current and complete. It is unlawful to misrepresent yourself in an attempt to gain access to someone else’s personal health data and unauthorized activities may be subject to prosecution.Your access to and use of the MyHealth site are subject to all applicable federal, state, local and international laws and regulations. All patient information viewed through MyHealth is strictly confidential and is subject to the protections of applicable state and federal law.

Account Deactivation

An account may be deemed abandoned and expired if the account has no activity for two calendar years. In order to maintain an active status on your account, then it is your responsibility to periodically login. Should your account be expired, you must contact Stanford Health Care in order to receive a new activation code.

Termination of Access

Abuse of the MyHealth privilege, excessive messaging, inappropriate usage of messaging, or repeated failure to show up for appointments that you have scheduled through MyHealth may cause your MyHealth access to be revoked without prior notice. SHC may terminate your access to MyHealth at any time, without notice, and with or without cause.

Notices sent to you by SHC in connection with MyHealth or these Terms and Conditions may be delivered by e-mail, by written communication delivered by First Class U.S. Mail, or a notice posted on the MyHealth site. You must give notice to SHC by First Class U.S Mail - postage prepaid, or by overnight courier, addressed to:

General

These Terms and Conditions constitute the entire agreement between you and SHC and govern your use of the website. This agreement supersedes any prior agreements between you and SHC relating to the access and/or use of the MyHealth site and associated apps and services. No modification or attempted modification of these Terms by you shall be binding on Stanford Health Care unless made in writing and physically signed by an authorized representative of Stanford Health Care.

A waiver of any breach of any provision of these Terms and Conditions shall not be deemed to be a waiver of any repetition of such breach or in any manner affect any other terms or conditions of these Terms and Conditions. The failure of SHC to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision.

If any provision of the Terms and Conditions is found to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect.

The use of this site is unauthorized in any jurisdiction that does not give effect to the Terms and Conditions contained herein.
